Q: What information does OFFBEAT1 collect?

From OFFBEAT1 Interactions with You: We collect information from and about you and your transactions and other interactions with us. This may include, but is not limited to, when you visit our Site(s), use the Services, create an online account with us, make a purchase, sign up for our catalog, newsletters or email lists, participate in sweepstakes, contests or other promotions, participate in a product review, survey, or other similar programs, send a gift or gift card to a person, or otherwise contact us, including via the online chat function. If you make a purchase from us, we may also collect a credit or debit card number or other financial information, CVV, and billing address. In addition, if you make a purchase at a designer boutique, restaurant, salon or other similar service offered within a section of a OFFBEAT1 store that is licensed by a third party (each a "Boutique Service"), we and the Boutique Service may each collect information such as your name, billing address, shipping address, telephone number, email address and payment or gift card information. Any such information is subject to this Privacy Policy if we collect or have it and subject to the Boutique Service’s privacy policy if the Boutique Service collects or has it.

If you download one of our Apps, you may choose to permit the App to obtain your precise geolocation. In this case, we will receive your location data sent from your mobile device. This is a setting you can enable or disable on your mobile device in connection with the App.

From Your OFFBEAT1 Credit Card Application: You may also be required to provide certain information when you apply for a OFFBEAT1 Fifth Avenue MasterCard® or the OFFBEAT1 Fifth Avenue private label credit card. We and the credit provider may be required to collect your name, address, email address, phone number, and other information needed to assess your credit worthiness and verify your identity, such as social security number, income, and employer information. We require this information to process your application, operate your account, and provide you with credit services. If you choose to link to the credit provider’s or other third-party site, they may have privacy policies that differ from our own and may make their own choices about privacy practices. You therefore should refer to their privacy policies to understand how they collect and handle your information and what kinds of choices you have.

From You About a Third Party: If you send someone else a communication from the Services (such as sending a gift or virtual gift card), we may collect information such as that person’s name, telephone number, email, and/or shipping address.

Q: What information does OFFBEAT1 sell or share with others?
A: OFFBEAT1 will never sell or rent your personally identifying information to third parties. OFFBEAT1 shares personal information and your communications with us with others to be able to improve our service and offerings to you and to enable the extension of the OFFBEAT1 brand and experience beyond OFFBEAT1 sites, or Services. In addition, OFFBEAT1 may share personal information we collect from and about you in the following ways

Co-Marketing Partners: Certain areas of the Services may be provided to you in association with third parties, such as companies that provide products and services, rewards programs, conduct joint sales programs (such as our Boutique Services in the stores), sweepstakes, promotional campaigns, and other jointly sponsored events. Such Services will identify the third party. If you elect to register for any products and/or services provided during the Services, you either will be providing your information to both OFFBEAT1 and such third party, or OFFBEAT1 might share your information directly with such third party for that third party to fulfill their products and our products and services directly with you.

Other Third Parties: OFFBEAT1 may share your information with select partners, affiliates, and other third parties that we believe may have offers or be of interest to you in support of your customer experience with us or others or to extend the OFFBEAT1 luxury and brand experience beyond our sites, stores, and Services.

Legal Disclosures; Safety: OFFBEAT1 may transfer and/or disclose the information we receive from and about you to comply with a legal obligation, to provide information to law enforcement and other governmental authorities in accordance with applicable law, and when we believe in good faith that the law requires it. We also reserve the right to share information with legal authorities and other companies for fraud protection and credit risk reduction, to detect any technical or security vulnerabilities, to enforce our Terms and Conditions or other applicable policies, or to otherwise protect the rights, property, safety, or security of third parties, users of the Services, OFFBEAT1, or the public.

Sale of Business: During the normal course of our business, we or our affiliated OFFBEAT1 Family of Companies may sell or purchase assets. If another entity acquires all or a part of a business owned or operated by OFFBEAT1, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against a business owned or operated by OFFBEAT1, such information may be considered an asset of the company and may be sold or transferred to third parties. OFFBEAT1 Credit Card Accounts: We may share your information with the financial institution that issues OFFBEAT1 credit card accounts (please see the "Credit Card Application" section, under "What information does OFFBEAT1 collect" for more information). This financial institution may use your information to improve its credit decisioning methodology for enhancements to OFFBEAT1 credit card accounts.

Service Providers: We use third-party "service providers" (also called “vendors”) to perform certain services on our behalf when the information is necessary for them to perform their duties. These third-party service providers are prohibited from using personal information for any other purpose and are contractually required to comply with all applicable laws and requirements, which may include Payment Card Industry Data Security Standards if they are processing or transmitting payments for the OFFBEAT1 Family of Companies.

Aggregate or Anonymous Non-Personal Information: We may also share or sell aggregate or anonymous information with or to our affiliates, agents, service providers, business partners, or other third parties for marketing or analytics uses, to improve the quality of their services, or for other lawful purposes. This type of non-identifiable and aggregate information cannot be used to identify you personally.

A: If you have registered for an account, you may view and update your account information by logging into the "Your Account" section of the Site or App with your email address and password. Once logged in, you can view or update your name, address, telephone number or email address

Q: What choices do I have about receiving communications from OFFBEAT1?
A: To receive promotional offers from OFFBEAT1, you can sign up on our Site or App or contact a Customer Service representative. If you register for an account or make a purchase, you will automatically receive promotional emails and direct mail from OFFBEAT1. We provide our customers with the opportunity to "opt out" of receiving emails or direct mailings other than those for purposes related to placement, processing, fulfillment or delivery of a product order or your transactions with us. We provide you with the following options if you prefer to "opt out" of receiving information or materials that we think may be of interest to you:

  • Electronic Promotional Offers: At all times, you have the option of "opting out" of receiving promotional emails from the sender only by clicking the "unsubscribe" link in any of the promotional emails you receive. In addition, if you have an online account, you may change your email preferences regarding email from us by logging into the "Your Account" section of the Site or App.
  • Direct Mail Promotional Offers: If you would like to be removed from our OFFBEAT1 catalog mailing list, please contact a Customer Service representative by email to stop receiving paper catalogs.
  • Mobile Alerts and Text Messages: OFFBEAT1 communicates via mobile text messages to customers who opt in to the OFFBEAT1 Mobile Alerts program, or otherwise agree to receive text messages.


For the OFFBEAT1 Mobile Alerts program, users can opt-in online or by texting a keyword to OFFBEAT1 in response to an invitation. Number of messages may vary. No purchase necessary. Recurring automated messages will be delivered to the phone number you provide at opt-in. Message and data rates may apply. Your instructions to limit the use of your information will be processed as soon as reasonably practicable. Supported carriers: AT&T, Verizon Wireless, Sprint PCS, T-Mobile, Virgin Mobile, US Cellular.

  • Push Notifications: When you use the App, you may receive push notifications. If you prefer not to receive push notifications, you may adjust your settings on your mobile device to control whether you want to receive these alerts.
  • App Geolocation Information: When you use the App on your mobile device, you may choose not to share your geolocation information with us by adjusting the device’s location service settings.

If you receive marketing communications from one or more companies within the OFFBEAT1 Family of Companies, you must opt out individually from each of the companies from which you are receiving company-specific marketing communications.

Q: What about children’s privacy?
A: Protecting children’s privacy is important to us, and the Site and App are not intended for children under the age of thirteen. We do not direct the Site or App to collect, and we do not knowingly collect, any personal information from such children. If OFFBEAT1 learns that a child under the age of thirteen has provided personally identifiable information to the Site or App, it will use reasonable efforts to remove such information from its files. OFFBEAT1 does not have actual knowledge about selling or sharing personal information of consumers under the age of 16.

A: We have taken certain physical, administrative, operational, and technical steps to safeguard the information we collect from and about our customers and Site visitors.
